1.0 Preamble / Scope

For all business relationships between Winery Jeff Konsbrück and the customer, the following General Terms and Conditions apply exclusively in the version valid at the time of the order. If the customer orders wines on the basis of the price list, these general terms and conditions of Winery Jeff Konsbrück apply exclusively.


2.0 contractual partner

Winery Jeff Konsbrück concludes contracts for wine deliveries exclusively with a) natural persons with unlimited legal capacity who have reached the age of 18, and b) legal persons with their place of residence or registered office in Luxembourg. By accepting the terms and conditions of Winery Jeff Konsbrück, the buyer confirms that he is of legal age (over 18 years old). Winery Jeff Konsbrück points out that wine packages are generally only handed out to people over the age of 18, ie the buyer must ensure that only adults receive the delivery when they are delivered.
 

3.0 Conclusion of the contract and storage of the contract text

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. After entering your personal data and clicking the “Buy” button, you place a binding order for the goods in the shopping cart. The receipt of the order is confirmed by an automated e-mail immediately after the order has been sent and does not yet constitute an acceptance of the contract. We can accept your order by sending a separate order confirmation by e-mail or by delivering the goods. All offers from Winery Jeff Konsbrück are non-binding. If the ordered wine is out of stock, Winery Jeff Konsbrück will offer the customer a product of equivalent quality, type and price by telephone or in writing. The contract language is German. 4.0 cancellation policy

Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

In order to exercise your right of withdrawal, you must send a clear declaration to us (Winery Jeff Konsbrück, 35, rue de la Résistance, L-5401, Ahn, phone: 00352 691 827 319, email: jeff@jk-winery.lu) (e.g. B. a letter sent by post or e-mail) of your decision to withdraw from this contract. 

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of the withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery we offer have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.

5.0 Prices / conditions / delivery / payment methods

5.1 Prices

All prices for the offered wines and articles, for packaging and shipping are shown in euros (EUR). The prices are to be understood as final prices and include the statutory value added tax including other price components. If we have not been able to determine any receipt of payment on our accounts within 30 days of the invoice date , the debtor / payment is deemed to be in default.

5.2. Shipping costs / minimum order value

For first orders, we only deliver on advance payment, the minimum order quantity is 6 bottles

The dispatch takes place within Luxembourg. 
The dispatch is carried out by UPS in tested special boxes of 6, 12 or 18 bottles.

Shipping

The dispatch takes place within the Federal Republic of Germany (only mainland) by the company UPS in tested dispatch boxes.

  • We ship in boxes of 6, 12 or 18 bottles.

  • The shipping costs are € 8.90 per box.

  • In the case of larger quantities, delivery takes place after consultation.
     

5.3. Delivery conditions

The delivery will be made as soon as possible. Articles in stock are dispatched within 2 - 4 days and (depending on the logistics partner) delivered to the customer within a further 2 - 4 days. In the case of articles that are not in stock, the customer will be informed about the unavailability and informed in good time about when the delivery will take place. You will be informed immediately in the event of delivery delays that exceed a week and of which we become aware. In the case of combined orders (items that can be delivered and items that cannot be delivered immediately), the customer decides whether he wants a separate or complete delivery. The delivery date is then based on the delivery time of the z. Item currently not available. We do not give a delivery guarantee or a guarantee of availability - the following applies: only while stocks last. Our offer is non-binding. The prices at the time of the order apply. If a vintage is sold out, the price is no longer valid.

5.4. shipping address

The delivery will be made to the delivery address you have given. Unless otherwise stated, this corresponds to the billing address. If you want a delivery address that differs from the billing address, please let us know when you place your order.

5.5. delivery

Deliveries are made during the week and also on Saturdays. If you want a delivery address that differs from the billing address, please let us know when you place your order. Please check directly upon receipt that the packages are undamaged and that you have received the correct number of products. Please have the delivery agent acknowledge incorrect deliveries or damage and then contact us. The statutory warranty rights to which you are entitled are not affected by this.

5.6 Terms of Payment

Payment can be made either in advance or on account. We always offer the option of paying in advance by bank transfer without surcharge. If you choose the payment method in advance, we will give you our bank details in the order confirmation. In the case of advance payment, the invoice amount must be transferred to our account within 6 days.

Depending on the payment method you have chosen, there may be a surcharge, which you will be informed about in the order overview.

You agree to receive invoices and credit notes in electronic form.

6.0 Retention of Title

Winery Jeff Konsbrück retains ownership of all goods that it delivers to a buyer until the purchase price and any shipping costs have been paid in full. If third parties access the reserved goods, the buyer will point out the ownership of Winery Jeff Konsbrück and notify Winery Jeff Konsbrück immediately. If the buyer is in default of payment or if he culpably fails to fulfill other essential contractual obligations, Winery Jeff Konsbrück is entitled to withdraw from the contract and to demand the return of the reserved goods or, if necessary, to demand the assignment of the buyer's claims for return against third parties.

7.0 Warranty

The statutory warranty rights apply to all goods from our shop.

8.0 liability

For this purpose, the name and address of the purchaser as well as the information on the ordered items from Weingut Ziegler are used to process the order process, the analysis for advertising purposes and to provide written information about other offers from Winery Jeff Konsbrück (advertising).

When registering and placing orders, personal data such as salutation, first name, surname, address, zip code, place, e-mail address, date of birth and telephone number are collected.
